Terms of service

1. The service

These Terms of Service are an agreement between you and Car Show HQ LLC
(“Car Show HQ”, “we”, “us”), a Virginia limited liability company.

Car Show HQ provides tools for running car shows: event pages, online
and day-of registration, payment collection through your own payment
provider, spectator voting, tallying, and awards. We may improve or
change features over time.

2. Your account

Keep your credentials secure; you are responsible for activity under
your account. Provide accurate information and keep it current. You
must be at least 18 to hold an organizer account.

If you give us a mobile number and agree to receive text messages, we
send service notifications only, such as signup and account alerts.
Message frequency varies, message and data rates may apply, and you
can reply STOP to stop receiving messages or HELP for help at any
time. Agreeing to receive texts is never a condition of using the
service.

3. Your events and your data

Your shows are yours. You are responsible for the events you run,
including venue arrangements, insurance, the content of your pages,
your liability waiver, and compliance with laws that apply to your
event. Registration, voting, and inquiry data collected through your
pages belongs to you; we host and process it to provide the service
(see section 7) and claim no other rights to it. You may export your
data at any time, and you are responsible for using it lawfully - for
example, not emailing registrants marketing they did not agree to.

4. Payments and refunds

Registration payments and donations are processed by the payment
provider you connect (for example Square, Stripe, or PayPal) under your own merchant
account. We are not the merchant of record, we never hold your funds,
and card details never touch our servers. Pricing disputes, refunds,
and chargebacks are between you, your registrants, and your payment
provider. Fees for using Car Show HQ itself, if any apply to your
plan, are described at signup.

5. Acceptable use

You agree not to:

  • use the platform for anything unlawful, deceptive, or harmful;
  • upload content you have no right to use, or that is defamatory or obscene;
  • attempt to access other organizations’ data or probe the platform’s security;
  • interfere with the service, scrape it at scale, or resell it without our agreement;
  • manipulate voting results by impersonation or automation.

We may suspend or remove content or accounts that violate these rules.

6. Availability

We work to keep the platform available and fast, including automated
health checks and rollbacks, but we do not promise uninterrupted or
error-free operation and this agreement includes no uptime guarantee.
We may perform maintenance, and where practical we will schedule it
outside typical event hours.

7. Data processing

For personal data your registrants and voters submit, you are the
controller and we are your processor. We process that data only to
provide the service, we protect it with the measures described in our
Privacy Policy,
we use the subprocessors listed there, and we will tell you without
undue delay if we learn of a breach affecting your data. When your
account is deleted we delete or anonymize your event data within a
reasonable period, except what we must keep by law.

8. Disclaimers

The service is provided “as is” and “as available”, without
warranties of any kind, express or implied, including merchantability
and fitness for a particular purpose. We are a software platform: we
are not a party to your events, and we are not responsible for what
happens at them.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect,
incidental, special, or consequential damages, or for lost profits,
revenue, or data. Our total liability for all claims arising out of
the service is limited to the amount you paid us for the service in
the twelve months before the claim arose, or one hundred US dollars
if you paid nothing.

10. Termination

You can stop using the service and delete your account at any time.
We may suspend or terminate accounts that violate these terms, or
discontinue the service with reasonable notice, in which case you
will have an opportunity to export your data first.

11. Changes to these terms

We may update these terms; for material changes we will notify
organizers by email before they take effect. Continuing to use the
service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Commonwealth of Virginia,
United States, without regard to conflict-of-law rules, and disputes
belong in the state or federal courts located there.
